Terms of Service

These Terms of Service ("Terms") govern your use of Spoek, a personal AI assistant operated by Simple Semantics (KvK 42012668), based in the Netherlands ("we", "us"). By using Spoek you agree to these Terms.

1. The service

Spoek is an AI assistant that you add to a Telegram or WhatsApp chat. It can answer questions, remember information you tell it, manage simple routines, and connect to optional services such as Google Calendar or Microsoft Outlook Calendar. Responses are generated by a large language model (Anthropic's Claude). Spoek may be incorrect, incomplete, or out of date — do not rely on it for legal, medical, financial, or safety-critical decisions.

2. Eligibility

You must be at least 16 years old and able to enter into a binding contract under the laws of your jurisdiction.

3. Your account and chat data

When you use Spoek, you are identified by your Telegram user ID or WhatsApp phone number. You are responsible for the security of the messaging account you use. If you add Spoek to a group chat, you confirm that you have authority to do so and that other participants are informed that an AI assistant is reading and responding to messages in that chat.

4. Acceptable use

You agree not to use Spoek to:

  • Break any applicable law or regulation;
  • Generate or distribute content that is unlawful, infringing, defamatory, harassing, sexually explicit involving minors, or designed to harm others;
  • Attempt to extract, copy, or reverse-engineer the underlying systems, prompts, or model weights;
  • Send spam or use the service to send unsolicited messages to third parties;
  • Probe, scan, or otherwise interfere with the integrity or availability of the service;
  • Misrepresent the assistant's output as professional advice (legal, medical, financial, etc.).

We may suspend or terminate access if you breach these rules.

5. Third-party services

Spoek runs on top of Telegram, WhatsApp, and (if you connect them) Google or Microsoft services. Your use of those platforms is also subject to their own terms. We are not responsible for outages, content moderation, or policy changes by those providers.

6. Intellectual property

The Spoek software, branding, prompts, and configuration are the property of Simple Semantics. Content you provide remains yours; you grant us the limited licence needed to operate the service (process the message, store it, send it to the language model, return a response). You retain ownership of the assistant's outputs to you, subject to the terms of the underlying language-model provider.

7. Fees

Spoek may be offered free of charge or on a paid basis. If a paid plan applies, the price and billing terms will be presented to you before you commit. We may change pricing for future billing periods with reasonable notice.

8. Disclaimer of warranties

The service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that responses are accurate, that the service will be uninterrupted, or that defects will be corrected.

9. Limitation of liability

To the maximum extent permitted by law, Simple Semantics is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill arising from your use of Spoek. Our aggregate liability for any claim relating to the service is limited to the greater of (a) the amount you paid us in the twelve months preceding the claim or (b) EUR 100. Nothing in these Terms limits liability that cannot be limited under Dutch law (such as liability for intent or gross negligence).

10. Termination

You can stop using Spoek at any time by removing the bot from your chat or by requesting account deletion (see our Data Deletion Instructions). We may suspend or terminate your access if you breach these Terms or if continued operation is no longer feasible.

11. Changes to these Terms

We may update these Terms as the service evolves. The "Last updated" date at the top of the page reflects the latest version. Continued use after a change constitutes acceptance of the updated Terms.

12. Governing law and jurisdiction

These Terms are governed by the laws of the Netherlands. Any dispute will be brought before the competent court in Amsterdam, the Netherlands, unless mandatory consumer-protection rules give you the right to bring proceedings in another forum.
